Research On Protection Of Broadcast Organization Right In Network Environment

Since the birth of radio technology,radio and television has gradually become a part of people’s lives,people through radio and television to understand social information,learning science and technology,enrich the daily life.Radio stations,television broadcasting organizations,in the production of radio programs in the process put a lot of manpower,material and financial resources.However,with the development of network technology,the behavior of pilfering broadcast signals becomes easy,which poses a serious challenge to the interests of broadcasting organizations.At present,most countries have made reference to the provisions of the Rome Convention to develop their own copyright laws.The development of the Rome Convention has been more than half a century ago.The original right protection mechanism is no longer meet the development requirements of the times.Especially in the network environment,the broadcasting organization system has many new features.What is most worth learning now is the improvement of the production of broadcasting organizations in the Draft Treaty on Broadcasting Organizations.On the basis of perfecting the four rights foundations under the Rome Convention,the draft proposes to add a number of new rights to meet the requirements of the development of the times.This provides intellectual support for the protection of broadcasting organizations’ rights under the network environment.For our country,China rapid development of radio and television,has now become the world’s largest network of radio coverage of the population.In the network environment,the development of broadcasting organizations plays a very important role in the development of broadcasting organizations and society.However,there are many imperfections in the protection of the right of broadcasting organization in the current copyright law,which gives many lawless elements an opportunity to exploit.Pirates of the broadcast signal behavior in the network environment is becoming more and more serious violations of the economic interests of broadcasting organizations.In addition,China broadcasting organizations bear the important task of propagating socialism,its protection can not be too blind.Therefore,in the last chapter of this article,based on the basis of our country,referring to the positive aspects of the draft of the Treaty on Broadcasting Organization,the author puts forward some suggestions on perfecting our broadcasting organization system under the network environment.
