With the administrative contract in our country in large quantities using,it has become an effective way to management the social public affairs of government.The legislation and practice of administrative contract in China recent years has gained rapidly,and achieved some success.But overall,both of the administrative contract and administrative priority research in our theory is not much,there is no nationwide administrative contract law,legislation of administrative contracts mainly scattered in various laws and regulations into some single administrative regulations,lack of systematic and legal order bit too low,and even different provisions of different administrative regulations contradict each other,leading to the practice of administrative contract is not satisfactory.Therefore,it is necessary to clarify some of the basic concepts of administrative contract,study and learn from outside experience,and depth study of the practical problems of the executive privilege of administrative Contract in the exercising process,and sort,analyze,i think this study will be beneficial to our country.
