With the rapid development of e-commerce and the "Internet +" concept of the rise of the express industry unprecedented rapid growth.China's express industry has maintained for three consecutive years more than double-digit growth,and long-term growth rate of more than 50%.Since 2016,through the middle platform for non-face-to-face transactions by leaps and bounds,to promote the courier industry to further rise and change.Today,the transport of goods by courier has become an important part of many people's daily lives,such as online shopping items delivery,documents,notes,and so on.However,consumers enjoy convenient,fast and efficient courier services,while its consumer rights have been repeatedly infringed,can not be very good protection.To protect the legitimate rights and interests of consumers in the courier service,not only has a legal basis,more importantly,has practical significance.In this context,from the perspective of protecting the legitimate rights and interests of consumers in the courier service,combining with the reality of China's express industry,analyzing the cause of the damage of consumers' rights and interests,the current protection system is insufficient,and so on.Constructive measures,with a view to give courier service consumers better protection.The article is divided into six parts to discuss the legal protection of consumer rights in China's express service,the main contents are as follows:The first part is the introduction,which is the part of this paper.This part mainly introduces the conception problems of the express industry,consumer,service consumption and the protection of consumers 'rights in courier service.In the form of the case,the paper puts forward the common problem of infringement of consumers' Behaviour,but due to various reasons leading to consumer relief is difficult,so the need to protect their legitimate rights and interests.The second part is the second chapter of the article,mainly on the protection of courier services in the consumer rights outlined,including the protection of courier services in consumer rights and interests of economic and civil law legal analysis,the current protection measures and express contract law And points out its shortcomings.The third part is the third chapter of the article,mainly discusses the protection of the status of courier service consumer rights.Analysis courier services against the interests of consumers in the main situation,as well as courier service consumers legitimate rights and interests of repeated violations of the reasons for analysis.The fourth part is the fourth chapter of the article,the main reference and learn from foreign courier services for the protection of consumer rights legislation and regulatory systems and other relevant provisions.This chapter mainly refers to the relevant provisions of the United States and Germany,and put forward the experience for reference.The fifth part is the fifth chapter of the article is the problem-solving part of this article is mainly to improve the accord with China's national conditions of the courier service consumer rights protection system,including the sound laws and regulations,improve the express industry regulatory system,,The trial courier service mandatory micro-insurance system and the protection of consumer personal information and other specific solutions,with a view to the courier industry to provide a sound consumer protection to improve the recommendations.The sixth part is the conclusion,based on the above analysis,the protection of consumer rights and interests in courier service,both legal basis and practical significance,and foreign experience,should be based on this perfect in line with our national conditions of the courier service protection of consumer rights System,and effectively protect the legitimate rights and interests of consumers in a weak position.
