Research On The Problems Of Cheating In Exams

In twenty-first Century,the social economy and people's living standards in our country has greatly developed,but the quality of the education system of our country but failed to keep up with the pace of economic development,resulting in the lack of social integrity of citizens in our country,cheating behavior intensified.Although China promulgated a new "criminal law amendment(nine)" the provisions of the crime of cheating in the exam,the type of behavior of four kinds of cheating in criminal law theory,for defects but cheating crime and relevant legislation still exists.Therefore,it is urgent to solve the problem of cheating in exams and to make up for the defects of the legislation.Through four chapters,this paper analyzes the problems existing in the crime of cheating in exams.The first chapter is an overview of the crime of cheating in the exam,the chapter is divided into two sections: the first section mainly from the three aspects of social culture,economic benefit,evaluation system reveals the cause of cheating crime;the second section mainly expounds the status of test cheating crime,on the one hand,analysis of the main features of the examination of crime in our country,on the other an analysis of the status quo of China's legislation on the crime of cheating and reference to the law at all times and in all countries.The second chapter is the research on the scope of the crime of cheating in the exam questions,the chapter is divided into three sections: the first section is mainly based on the theory of criminal law and other relevant administrative regulations and rules of inquiry in criminal law of China "national examination";section second to two broad and narrow legal theory as the basis,discussion the cheating crime in the "law" of the constraints contained in the scope of the law.In the third section,the author makes a deep analysis of the secret of the "questions and answers" in the crime of cheating in the examination by the relevant provisions of the law of our country.The third chapter is the research on the criminal issues in training,the chapter is divided into two sections: the first section is about the training compared to theforeign related legislation and combining with our different theories of dialectical analysis of the specific law violations of our training behavior.In the second section,the author makes a comparative analysis of the rationality of the relevant provisions of the crime of cheating in examinations,and puts forward some relevant suggestions.,The fourth chapter is the research about cheating crime and quantity of crime,complicity,this chapter is divided into two sections,the first section is the research of crime problems,the crime of cheating on the test part of the specific type of behavior and attitude to suspend the accomplished standard and other difficult problems are discussed in section second is the number of analysis;the problem of accomplice and crime,the specific crimes in internal as well as specific charges and other related charges of criminal law crime of cheating in the examination of the Festival Competition and accomplice relationship analyses.
