Researh On The Crime Of Cheating In Exams

Now organized,planned,cheating with the commercial nature of the organization of the examination,increasingly large scale,means more and more complex,more and more interests,intensified,social use of criminal law to regulate the voice of increasing.2015 in August by the"People's Republic of China criminal law amendment(nine)"(the following referred to as the "criminal law amendment(nine)),criminal law amendment(nine)four common provisions on the criminal responsibility of cheating on exams,for combat cheating in the direct legal basis.The establishment of a new organization--charges of cheating crime,for the group Fabric cheating behavior for a specific penalty provisions,but because the "criminal law amendment(nine)" just introduced,there is no mature consensus on the problems existed in the theory of criminal law,cause some problems to the judicial practice.Based on the analysis of the legislative background and content of the crime of cheating,discusses the organization for cheating crime legislation and judicial problems,and puts forward some suggestions for perfecting the organization of the crime of cheating in the exam,in order to better use in judicial practice.
