Studies On Legal Protection Of Intellectual Property Rights Of Uyghur Traditional Ethnic Medicine

Uyghur traditional ethnic medicine is an important component of traditional Chinese medicine,and the outcome of the integration of Uyghur traditional ethnic medicine and traditional cultural knowledge with unique national characteristics and local style.Uyghur traditional ethnic medicine has a long history,and the inherence and development of Uyghur traditional ethnic medicine has been greatly influenced by traditional Chinese medicine.With its own distinct and characteristic foundational system and exquisite clinical experience,it is an important part of traditional Chinese medicine and Uyghur traditional culture treasury.For a long time,Uyghur traditional ethnic medicine has developed together with traditional Chinese medicine to constitute a complete system of Chinese traditional medical science with medicine in other ethnic minorities through mutual infusion and integration.However,influenced by other factors,the intellectual property of traditional ethnic medicine did not attract great attention so that the industrialization development of traditional ethnic medicine was restricted.With the progress and promotion of national “One Belt One Road” strategy,China has attached great importance to the inherence and development of traditional ethnic medicine.This has laid solid foundation for the progress and development of Chinese national characteristic traditional ethnic medicine.This article will discuss intellectual property protection of Uyghur traditional ethnic medicine from following five parts:Part one is the introduction which has briefly elaborated the research purpose,research significance and domestic and foreign research status so as to lay a theoretical foundation for carrying out subject research.The second part has mainly demonstrated the necessity of intellectual property protection of Uyghur traditional ethic medicine.For the convenience of having a general mastery of Uyghur traditional national medicine,this paper has firstly sorted out the concept,features and development status of Uyghur traditional ethnic medicine.Next the paper has specifically demonstrated the significance of intellectual property protection of Uyghur traditional ethic medicine.The paper holds the view that intellectual property protection of Uyghur traditional ethic medicine is good for inheriting Uyghur traditional ethic medical knowledge,standardize Uyghur traditional ethnic medical industry and safeguard the interest of Uyghur traditionalethic medicine.The third part has introduced the IPR(intellectual property protection)system of traditional medicine in foreign countries.Firstly,the paper has discussed the current situation of international legislation in this field,and then summarized the measures for IPR of traditional medicine in some countries.The fourth part has summarized the current situation of IPR of Uyghur traditional ethnic medicine from aspects of trademark protection,geographical indication protection,copyright protection and commercial secret protection,etc.The fifth part has proposed perfecting suggestions targeting at IPR of Uyghur traditional ethnic medicine from aspects of patent,trademark,geographical indication,copyright protection and commercial secret protection and intangible cultural heritage protection for the purpose of benefiting the development of Uyghur traditional ethnic medicine.
