Research On Legal System Of The Enterprise Credit Regulation

Enterprise credit is an important part of social credit system, improving enterprise credit has a significance impact on promoting the development of the enterprise,the stability of the credit economy as well as the social integrity progress. However, nowadays relevant legal regulation for enterprise credit in our country is very limited,especially the supervision system for enterprise credit that is in a vacuum state,which leads to a series of problems of credit economy and has gradually become a serious obstacle in building up the social credit system. In order to solve the issue,the main argument in this article is to research the enterprise credit regulation through the perspective of legal interpretation, building up the enterprise credit supervision legal system to improve the society credit system. This article based on the fundamental theory of enterprise credit,analyzes the existing problems in the enterprise credit regulation, along with compared to the mature experience from other countries, thus provides proposals to improve the construction of enterprise credit supervision legal system.This paper is composed of the following four parts:The first part is an overview of enterprise credit regulation. Analyzing the theory of credit from a legal perspective,defining the concept of enterprise credit,and sorting it into different types according to their characteristics. Analyzing the relationship between the enterprise credit and market economy, and identify the important role which the enterprise credit plays in the development of market economy. Moreover, the necessity and feasibility of establishing enterprise credit regulation system in national economy as well as society credit system have also been figured out.The second part is the current problems of enterprise credit regulation in our country. China has not yet constructed a special enterprise credit supervision legal system,which leads to a series of problems in the enterprise credit. This article analyzes the present situation of the enterprise credit supervision legal system in China, and identifies some issues need to be solved, which including the imperfection of enterprise credit supervision legal system,lagging of enterprise credit evaluation, and lack of the punishment for enterprise discredited. All of these imply the importance of building up an enterprise credit supervision legal system.The third part is to learn the experience of enterprise credit supervision from other countries. This part mainly analyzes the different types in enterprise credit supervision legal system overseas, which are market-oriented model, government-oriented model. The characteristics of the two models have been introduced briefly, and based on that analyze and summarizes the absorbable mature experience that our country can learn from refer to the enterprise credit supervision legal regulation, Identifying the difference between market-oriented model and government-oriented model has a positive impact on establishing enterprise credit supervision system in our country,especially the government-oriented model, which is more consist with the current credit economy development situation in our country.The fourth part is some proposals to institutionalized our country's enterprise credit regulation. This part is based on the analysis of enterprise credit supervision regulations and the existing problem of these regulations,integrating current rules and regulations of enterprise credit regulatory, as well as the experience of local government's actively experience in enterprise credit so far. This part mainly put forwards suggestions to improve the enterprise credit supervision from the legal perspective,perfecting the construction of enterprise credit supervision legal system,by means of creating enterprise credit information publicity system, enterprise credit evaluation and supervision system, together with discredited conduct punishment system. All of those are aiming to enhance the legal system of our country's enterprise credit supervision and promote the construction of social credit system.
