In view of the present situation of the enterprise credit crisis in our country, this thesis aims to analyze how to utilize the law in the interpretation and regulation of the enterprise credit from a fresh perspective, and further to establish and optimize an enterprise credit system according with the current development of our country. Based on the basic theories of credit, this paper uses the establishment and development of the law of enterprise credit abroad for reference, examines the limitation of the existing policies and laws home, and discusses its establishment systematically through the integration of the approaches of law and economics, thus throws light on the establishment of our own law system of enterprise credit.This paper consists of four parts as following.The first part introduces the basic theories of enterprise credit. Starting with the basic theories, the author studies credit from the perspectives of law and economics to acquire a better understanding of its content, and meanwhile he analyzes the necessity of establishing such a law system.The second part examines the law of enterprise credit abroad which presents three patterns, namely, market-dominated, government-dominated and member ,and discusses how to use the experience for reference through the comparison of the above three patterns.The third part carries on the analysis of the existing enterprise credit system in our country from three perspectives, the enterprise itself, the social economic environment and the legal system. This analysis helps to figure out the existing problems and provide the factual basis of the establishment and optimizing of the law.The last part puts forward the suggestion on optimizing the law of enterprise credit. Moreover, based on the required fundamental principles, it illustrates a series of systems and regulations, such as civil law related to the enterprise credit system, the evaluation and supervision of the enterprise credit system, and the punishment system to the breaking of enterprise credit.
