Research On The Legal System Of Community Service For Home-care Of Elderly In China

With the high-speed development of the modern society,Aging-population has becoming a global inevitable social problem.The actuality of aging of each country has closely connection with its own national conditions,China's leading features can be concluded as the huge Aging-population base,the rapid development,big Empty-nest elderly proportion and so on.As Aging-population brings negative effects to China's political,economy and culture and demands China's Elder-care system severely,the traditional family supporting and the institutions can no longer follow the steps of the modern Elder-care trends for their born defects.As a new system,Community service for home-care of elderly has the superiority of lower cost,higher efficiency and complete functions,so it's a must choice for China and been proved wise by some cities in China.Nevertheless,due to the new system is in the beginning period,it isn't being well protected or governed by accompanying legal system,lots of communities cannot get rid of the troubles,such as lack of funds, low service level,low personal professional level,disordered management and insufficient functions.My paper will analyze the legislative status quo of China's Community service for home-care of elderly to argue the urgent legal issues involved,then put forward some related legislative proposals to improve the care system to be a higher level.There are 4 parts of my paper:Part 1 :Summarize of the definition,features and the relevant theories of the system of Community service for home-care of elderly in China.Part 2:Analyses of the development and current situations of the system,then extract the legal issues and legislation deficiency involved.Part 3:Comparing of extraterritorial similar system, including the British Community care system, Japan's home care system and Long-term care insurance system,and mirror the successful experiences of them.Part 4:Discussion of the specific procedures of the legal care system from the aspects of the Institutionalization and standardization system,Financing and regulatory institution and the Long-term care insurance system.
