Research On The Mechanism Of Intellectual Property-Sharing In Collaborative Innovation

The collaborative innovation and intellectual property are two great strategic missions drawn up by our country government. They also receive more and more attention. In fact, the short of a reasonable and effective sharing mechanism for intellectual property is the biggest obstacle for collaborative innovation in China. It is the lack of systematical research about the power base, the conflict that may occur and sharing mechanism of IP sharing for collaborative innovation. So, on the basis of collecting domestic and international research data, the thesis analyses the power base of IP sharing for collaborative innovation, and establishes a theoretical basis for the later analysis. Basis on the internal logical relationship of IP sharing and protection for collaborative innovation, the thesis reveals their internal logical relationship by systematical research on the legal relationships of IP sharing for collaborative innovation, and proposes the way of construction for sharing mechanism.The research content of this thesis mainly embraces such sections as followed.1.Literature review and analysis of basis theory. Through sorting out the relationships between collaborative innovation theory and intellectual property theory,the section would lay a good foundation of later research.2.The power base of IP sharing for collaborative innovation. In fact, the innovation process for the earlier stage is the investment process, and the proportion of human capital input, collaborative innovation element input and intellectual capital input is the foundation of benefit distribution. As the basis of intellectual property laws, the balance of benefits can make the most of protecting the promoting action of intellectual property on society. By contract governance, clarifying the belonging of intellectual property and clarifying the rights and obligations of every side, making the goal of more balanced respective interests. Rationality of ruling by law, ethical system of IP sharing and legal system of IP sharing should be developed in parallel3.Conflict analysis on IP sharing for collaborative innovation.
