On the background of accelerating current aging process, strengthen and improve the elderly social security system of laws and regulations are particularly important and urgent. Based on the national conditions of the current social transformation and the severe increasing of aging population, This thesis investigate how to improve the performance of the obligations in our country elderly social security with the perspective of social security rights of citizens in article 45 of the constitution.This thesis is divided into five parts. Part one explains the basic concepts related to the social security of older people, overview the legal origin of national and social obligations protection of elderly and practical significance of improving of fulfill the obligations of the social security of older people. Then it analyze the logical structure and the corresponding rights and obligations of social security for the elderly, which explore the theoretical basis for the pad set realistic national and social security obligations for the elderly performed below. Part two discusses the status quo, problems and causes of the elderly community to fulfill its obligation to protect the country. This part summarized the current social security of China for older people to fulfill obligations from three angles of the status of national legislation, law enforcement and the judiciary. It pointing out its deficiencies and the cause of the problem. Part three briefly introduce the obligations of foreign social security of the elderly and its enlightenment to China. Mainly it introduces the elderly social security basic status of three Asian countries like Singapore, South Korea, and Japan. It seek the benefit enlightenment to China of social security from the experience of the development of the social security system of these countries. Part four is proposed to improve the suggestions of country's obligation to the elderly of social security. On the one hand the right to social of the elderly needs the protection of constitutional norms; on the other hand, the state cannot solve all problems of the elderly. Countries improve the fulfilment of their obligations in the field of social security of the elderly needed from three aspects: the legislative, law enforcement and judicial. Part five is the conclusion. It summarizes the content of the paper and improve the system within reach of a proposed vision.
