Theory On The Construction Of Administrative Public Interest Litigation System In China

At present, the public interests all over the country are abused frequently, shocking consequences, because of deficiencies in the system and the lack of effective remedies, and then intensified. Based on this, this article tries to explore the administrative public interest litigation, to build a suitable set for administrative public interest litigation in China.In this paper, four parts existed in addition to the introduction. The first part is a general principle of administrative public interest litigation in the analysis. Through an overview about the meaning of public interest, and expounding the connotation of public interest as the basis concept, through a brief analysis of the administrative public interest litigation, cleared the features and value of the public administrative proceedings.The second part introduces the legal basis for the establishment of the Public Interest Litigation in this country. From the institutional basis and the realistic foundation, and explained the possibility of the implementation for Public Interest Litigation in this country, and provided guidance.The third part is a comparative analysis on relevant content of extraterritorial public interest litigation, from the plaintiff qualification and the scope of the case, and the development on proceedings of national specialties, to understand the features and advantages.The fourth part is about the litigation arrangements about the system of Administrative Public Interest.Systematic exposition on the major problems above for the construction of Administrative Public Interest Litigation. Referenced the experiences and lessons of each country, combined with China's specific national conditions, localized the Administrative Public Interest Litigation and proposed the ideas and suggestions for the construction of Chinese-style system.
