Research On The Legal Protection Of Non Material Cultural Heritage Of Theintellectual Property Rights

The Chinese nation has formed a distinctive China cultural circle of the intangible culture heritage gradually in the long history.with the rapid development of economic and cultural globaization and the era of science and technology,the intangible heritage is an impaotant of human pracitical activities,with more cultural value and economic value.Facing the problem of non material point of view on how to protect the scholats of intangible cultural heritage from the perspective of intellectual property rights.The introduction describes the research background,research contents,researh significance and reserch method.This paper is divided into four chapters.the first chapter of the intangible cultural heritage and intellectual property and other related concepts are explained and analyzed,and the concept of the similar distinction,at the same time putforward the non-material cultural heritage of the natural attibutes,social attribtes and cultural attributes of the three characteristics.the second chapter through the study of international organizations,countries and domestic current situation of the protection of cultural heritage of nonlegal matter,put forward the legal issue of the intangible cultural heritage protection of intellectual property rights of our country,the third chapter is the Xiaogan City,Hubei province intangible intellectual property protection research and empirical cultural heritage,though to the Dongyong legend,Xiaogan engraved paper-cutting,Shanshu,Yunmeng shadow play,Drum dance,the five items of intangible cultural heritage of questionnaires and interviews,summed up the protection of intangible cultural heritage,the probem of Xiaogan city of Hubei province.The fourth chapter is thinking of intangible cultural heritage protection of intellectual property rights,put forward the intangible cultural heritage protection of intellectual property in the construction principle,and from the six aspects of intellectual property protection systerm of intangible cultural heritage.
