The Study Of The Automatic Renewal Problem Of The Right To Use Construction Land For Dwellings

As is well known to us,the provision that the right of using land for constructing dwelling houses shall be automatically renewed when it expired is clearly stipulated in the Property Law.Automatically renewal means right-holders do not need to apply for it by signing new contract.In order to make this right become a kind of usufructuary right that can be enjoyed forever once obtained,the times and period of renewal shall not be restricted.As for whether it is free or not to renew,the answer may be free in the terms of filling the legal loopholes.However,right coexists with boundaries.The objection of automatically renewal-the right of using land for constructing dwelling houses-should be properly restricted.In addition,collecting real estate tax is a suitable policy.All these problems considered,there are six parts in this thesis.Part ?,introduction.This part briefly introduces the current situation in the the academic field concerned,thus the subject of the thesis is put forward.At the same time,its method and the train of thought are given.Part ?,Case analyzing and its controversies.In this part,two far-reaching events are analyzed,and three pieces of controversy are concluded,namely,whether it is allowed to automatically renew this kind of right,whether it is free.And in the end,is there any restriction in the renewing procedure?Part ?,The understanding of the automatic renewal.This part systemically concludes the stipulations concerned,and illustrates the procedural requirements of automatic renewal.Part ?,The analysis of free renewal,which consists of two parts,one is the related theories,the other solution.Part ?,The limitation on right to renew.This part is the most meaningful of thisarticle,which gives detailed re-definition of the objection of automatically renewal and the hypothesis of real estate taxes.Part ?,conclusion.In this session,the author draws the conclusion of this article with key points mentioned.
