Last line of defense as guarantee of food safety,food recall system is very important.Food recall system on the one hand,can to a great extent,prevent the spread of food safety accidents,avoid cause more damage,on the other hand also restore economic losses to consumers,reflect the responsible attitude to consumers.Related to the reputation of the enterprises will be greatly affected,to the enterprise also is very good warning and admonition.Food recall system in China started relatively late,effective as of September 1,2015 of the ‘food safety management method' for China's food recall system has made a more detailed provisions,but from the ‘Shanghai Fuxi' event of 2014 to the ‘Anhui Laoyashan' event of 2016,we can see that food recall system in our country is still just a paper,with the advancement of social work concept,improve and implement food recall system is very necessary.This article on the food recall system evaluation,on the basis of the improvement of the food recall system in China are proposed.In this paper,the basic structure and the train of thought are as follows: the first part mainly introduces the basic theory of food recall.On the basis of clarity of the concept of food recall,this paper introduces the difference with the general product recall,and theoretical basis of system construction has carried on the detailed explanation.Extraterritorial food recall in the second part introduces the legislative cases,through to the United States,the European Union and Australia's food recall system is introduced,theire food recall system has made the corresponding evaluation.The third part through to our country the present situation of legal system of food recall,analyzes the problems existing in the legal system of food recall,includes the legal system,subject,information release,recall funds and subsequent disposal of five aspects of the problem.As the core of this article,the fourth part focus on the food recall law system of our country put forward the corresponding proposal,first of all,law should perfect our country's food recall system,secondly,should expand the scope of the main body of China's food recall,once again,should perfect our food recall risk communication and information release mechanism,fourth,should perfect our country the cost of food recall sharing mechanism,finally,should subsequent disposal of perfecting our country's food recall system.
