Reform And Improvement Of China’s Food Recall System

Food recall has been established as a system in many countries,particuly mature in thethe USA,Austrlia and other contries.The system has played an important role in theprevention of unsafe food from enterring the market. Food Safety Law enacted in2009, Article53establishes the system, indicates that China’s food safety and international standards, represents theprogress of the rule of law in China. However, China’s food safety incidents occur frequently, thelife and health of consumers, property safety are a serious threat because the food recallsystem shall not detailed enough, and be full of loopholes, broad and macro.It does not reallyplay to prevent and guard against unsafe products from reaching the role of the market.Tothe situation of the food recall system, the auther leads to the purpose of this study on China’sreform and improvement of food recall system.As the protection of God of food safety, thereform and perfect of food recall system becomes imminent.The paper starts from the basic theoretical problems of the food recall system, first definethe basic concepts of food recall system, the basic content and the development of food recallvalue and significance; then the legal basis for the food recall system, regulators, recallclassification, level of recall, recall the level of recall procedures and legal consequences ofthe angle, horizontal comparative analysis of the United States, Canada, Australia and NewZealand food recall system; compared to developed countries food recall system, chapter3focuses on the analysis of defects,of China’s food recall system.They include:the legal systemis imperfect, political and regulatory system is not perfect, food recall related to system isincomplete, light penalties for violation of the food recall system behavior, there is nodeterrence, social supervision system is incomplete. Finally, the paper improve China’s foodrecall system from three levels of government, business, consumer response,for our foodrecall system exist the defects from reality,drawing on foreign development of this system toimprove the experience, the guidance of scientific concept of development.
