A Study On The Protection Of The Property Rights Of The Minor Children With Parents’ Divorce

In recent years,China’s divorce rate has been rising.No matter in the legislation or in the judicial practice people pay more attention to how to divide the property of the couple,pay less attention to the rights and interests of the minor children.So it is an important issue that how to research the minors’ property,improve the relevant laws and regulations,minimize damage to minors and protect minors property rights.This paper is divided into four parts:The first part is an overview of the protection of the property rights and interests of the minor children.First of all,this paper expounds the concept and characteristics of the minor children whose parents divorce,and the concept and content of the property rights and interests of the minor children.Secondly it talks about the history of protection of property rights and interests of the minor children.Thirdly it illustrates the necessity of property rights and interests of minors.Finally it tells about the significance of protection of minor’s property rights.The second part talks about the deficiency of protection to minor’s property rights and interests.The third part introduces the experiences of protection to minor’s property rights and interests of foreign country.The forth part puts forward the measures to improve the protection of the property rights of the minor children of our parents’ divorce.
