| Though UN Convention on the Rights of the Child has come into effect for 24 years in China, privacy protection of juveniles is still marginalized and related theoretical research is still weak because of China's thousand-year-old traditional thoughts. Television, having relative advantages in the changeable and turbulent field of news media, did not do well in privacy protection of the juveniles in its news report.Based on this fact, to study privacy protection of the juveniles in TV news report is of vital importance for related theoretical study and practice in law and journalism.People may differ on this topic: In the past thousands of years,was there really a tradition to bring up children with loving care in China? Or was that love only a hint of tenderness in the cold patriarchy society? But it is beyond doubt that children are of no independent rights and are regarded only as a part of the society or family. Along with the developing society, increasing attention and recognition given to children's rights and gradual awareness of children as independent subjects have provided the soil for the application of "Principle of maximum benefit" from Convention on the Rights of the Child. This principle is suitable to and should be reflected in laws and regulations to protect the children and related practice. TV news reports should also abide by this rule when it comes to privacy protection of juveniles.Juveniles are not mature both physically and mentally. If television is to follow"Principle of maximum benefit" to protect privacy of the children in its news reports, it has to stick to three principles to secure it: media's notice of the report, assent of the privacy right holder and more stringent media protection. According to the analysis above, China should improve its system and guarantee juveniles' privacy right in TV news report with legal and industry standards. At the same time, workable reliefs should be provided by giving independent litigation right concerning privacy protection of juveniles and establishing procedure supervisor system in those independent litigations. |
