Study On The Legal Protection Of Current News Reports

In the field of legal science, it has been severely disputed whether the current news reports should be protected by law, and mainly argued whether the current news reports have originality, whether it has the rationality for the protection of the current news reports, and so on. Through the general introduction of the legal protection of the current news reports, the analysis on the rationality of the copyright protection of the current news work, and the expatiate on the reasonable construction of the legal protection system of the current news reports, this article has concluded that the current news work should be included in the protection range of China's copyright law, and the author has also put forward his suggestion on lawmaking.This article includes foreword, main text and conclusion. The main text is divided into four chapters.The first chapter "the general introduction of the legal protection of the current news reports" divides into three sections .Mainly discussed that the term of current news should be replaced by the term of current news reports in the first section; and the meaning of it is explained in the second; and the causes and disadvantages caused by the exclusion of the copyright of the current news; and then the author's opinion has been put forward in the third.The second chapters "the definition of the current news work" divides into three sections. Based on the theory of "thought and expression dichotomy" and the theory of work's originality, it has been discussed that the current news work is also a kind of expression and it has originality, and also set up criterions for the definition of the current news work.The third chapter "the analysis on the rationality of the copyright protection of the current news work" divides into three sections. Starting respectively from the labor-based property theory, the personality-based property, and the incentive theory, the rationality of the copyright protection of the current news work has been discussed.The fourth chapter "the expatiation on the reasonable construction of the legal protection system of the current news reports" is divided into three sections. Section one has made a brief introduction and comments of the situation of the current news reports that being protected by some major foreign countries; section two, to talk about is the legal status quo of the current news in our country; the last, aiming at how to protect the current news reports in our country, the author put forward his suggestion on lawmaking.
