Research On The Application Of Character Evidence In Juvenile Criminal Procedure

The character evidence was first appeared in the evidence law of Anglo American law system,for juvenile offenders,the value of character evidence is that it can effectively weaken the label of juvenile offenders,creating good conditions for their transformation,give them the opportunity to restart themselves,conducive to the formation of docile character.Through the introduction and application of character evidence,minors can realize their mistakes in time,draw lessons,the prevention of juvenile delinquency has achieved good results,reducing the source of crime in the future society.Because of the character evidence in our country's legislation has not yet been clearly confirmed,although there is no relevant provisions of character evidence in China's evidence law,but it has made special provisions for juvenile criminal cases,justice practice will be applied to character evidence in juvenile criminal.However,the application of character evidence in juvenile criminal cases does not have the support of relevant legislation,lead to the separation of legislation and Practice.So we should focus on the criminal cases of minors in the application of character evidence to make legislative standard,based on the practice of juvenile justice in China,understanding the basic concept of character evidence,make the Standard of applicability for good character evidence and bad character evidence,identification of the relevance between the unified evidence and the facts of the case,as well as the role and reference function of accurately distinguishing the character evidence in the case trial.
