Penalty enforcement is that the state relying on national coercive power to make the finality of judgment based on criminal judgments.This criminal judicial activities mainly aimed at transforming the objective behavior and the subjective psychological problems of the prisoners and making them accept legal sanctions and complete a remodeling of the subjective world,so that their internal world values can match up with the social values so as to reduce the possibility of recidivism when prisoners back into the community,thereby achieving the purpose of maintaining the social orders.Elderly,sick and disabled prisoners are a very special group in the object of execution.They are very difficult to supervise because of the disease or limb defects in addition to the characteristics of other prisoners.The current "Prison Law" in China has many the principle of provisions but lacks of specific implementation basis on how to execute a punishment of the elderly,sick and disabled prisoners,which makes the specific implementation of the practice of empiricism prevalent.With no specific implementation basis on the elderly,sick and disabled prisoners’ management,different ways of implementation are shown;and there are security,placement and other aspects of deficiencies for the old,sick and disabled prisoners,which directly affect the transformation of such prisoners,so that have impact on such prisoners when they returning to society,and has also brought a variety of challenges on the realization of the functions of the prison itself.Therefore,how to achieve a better punishment of the old,the sick and disabled prisoners has important significance on achieving the purpose of the implementation of humanistic care while playing the educational role of punishment,protecting the legitimate rights and interests of citizens and practicing leniency with the basic Criminal policy in the criminal justice activities.It is of great significance to improve the implementation of the penalties for the old,sick and disabled prisoners and to put forward effective management measures whether to protect the basic rights and interests of prisoners or to maintain the safety of supervision and improve the efficiency of implementation.Based on the analysis of the existing problems in the execution of criminal punishment,the paper hopes to provide some help to the elderly,sick and disabled prisoners in the implementation of various aspects,so that to carry out more perfect penalties for this particular group.This paper is divided into four parts,including the introduction,taking the basic situation of municipal prison-S City as a sample to carry out case study.The paper introduces the problems existing in the implementation of the penalty,and then puts forward some suggestions from the aspects of the enforcement of the legislation,the state of the legislation and the difficulties encountered in the practice.
