Research On Punitive Damages System For Food Safety In China

At present,China's provisions of the food safety punitive system is the"Food Safety Law" Article 148,paragraph 2.In addition,Article 47 of the Tort Liability Act and Article 55 of the Consumer Protection Law are also involved.However,the three laws of food safety punitive compensation system is still improved,and the system involved in the operation of the actual utility is limited,leading to China's food safety situation is still grim.Therefore,the author believes that we should sort out the basic theory of the existing system in our country,and make some suggestions to improve the punitive damages system of food safety in our country through investigation,research and analysis.In addition to the introduction and conclusion of this article there are four main parts:the introduction part is mainly on the main content of the article,research methods and innovation points.The first part of the text is an overview of the basic theory of food safety punitive damages.The second part is the analysis of the deficiency of our system which combined with the current three laws on the punitive damages system of the relevant provisions.The third part is the analysis of the shortcomings of China' s food safety punitive damages system.The fourth part puts forward suggestions for improving the punitive damages for food safety in China.
