Research On The Court's Evidence Collection In Civil Procedure

The court's evidence collection is an important part of civil procedure.It plays an important role in civil procedure.This system is beneficial to improve such a situation that it is difficult for clients to investigate and collect evidence.However,we have to admit that this system is legitimacy and necessity,to some extent.In addition,we should catch sight of the objection about the court's evidence collection.This objection have an affect on the exercise of civil's evidence collection.We should do something to solve this question.This article discusses the court investigation and evidence collection.It is divided into five parts.The first part is the introduction,in this part,this article analysis some viewpoint about court's evidence collection and discuss the necessity of court's evidence collection.In the second part of this paper,it defines the meaning of court investigation and evidence collect;giving a brief introduction about civil's evidence collection;discussing the classification of the court's evidence collection.analyzing the author's point about the relationship between the civil's evidence collection and the clients' evidence collection /the burden of proof/ the neutralization of the judge.In the third part about this paper,it is recommends the civil's evidence collection and evidence discovery system about foreign countries and regions,and analysis the implications to our country.In the fourth part about this paper,it is analyzes the referee instruments of Jiangxi court from 2009 to 2016 and discusses the practice about the court investigation and evidence collection,then analyzes the problems in the practice.In the fifth part about this paper,it targeted to improve the concept of civil's evidence collection,aiming to make the court investigation and evidence collection more standardized.
