A document that released by the State Council of People's Republic of China proposed that china will start a new era of residential block system.Internet users over opening up gated residential communities to public road system,so as to solve problems resisted in traffic network distribution and promote the cost-benefit land use policy.Nowadays,With the development of urbanization,transportation and basic public facilities in urban area can not meet its growing population pressures,accompanying with problems such as economic inefficiency as well as low-quality life.In order to improve these problems,the government uses its power to protect citizens' rights,however,it will also leads to a conflict between public power and private rights,which has always been a problem to reconcile.Meanwhile,it will also seriously affect the national and individual interests,even to trigger serious social conflict.The establishment of opening residential quarter plays an important rule to reflect citizen's individual interest as well as their private rights,however,opening up gated residential communities means a way that public power intervene the private rights.how to balance the relationship between them is the reason that I choose this topic for my thesis.This thesis will combine the relationship of public power and private rights,to discuss the advantages and disadvantages of opening residential quarter,analyze how and why those conflicts resist under opening residential quarter policy.So as to explore a way both to protect individual rights as well as solve social problems,and offering a proposal in order that could perfect the city planning legal system.
