Material Information In Fraud

Fraud violates the principle of utmost good faith,dislocates the economy,endangers the development of market economy.It is meaningful to refine the constitutive requirements of fraud and clear the content of material information and obligation to disclose material information.According to relevant theories and the latest achievements about fraud research,this paper will put forward different opinions about the component elements of fraud.The paper is divided into four parts: The first part mainly described the headstream and the concept of fraud and made a distinction about frauds,misrepresentation,seriously misunderstanding,coercive act and “Hitting When Others Are Down” act and fair loss;The second part comb the different opinions about the constitutive requirements of fraud and refine the constitutive requirements of fraud;The third part analysis the practice and problems about material information identification and give some recommendations about material information identification and how to disclose material information;The fourth part concentrates on material information meaning,identification and Legal responsibility.
