With the rise od webcast technology,gamers could be a game anchor thouth switching identity by a computer around them.Giving the webcast tool'simplicity,popularity and entertainment,webcast gradually becomes akind of culture.The court ruled that game graphics itself belong to the film works,but denied the possibility of considering game competitions graphics as film works.Jurists also discussed the problem about this and opinions were widely divided.From the different point of view,gamers who have different levels in different games cause works' different property of operation graphics.This paper discovers that Transformative use's space left by games itself is the main reason foe this different under further study.The forbidden provision for Net Ease's nser agreement is unreasonable.So game master anchor can use it reasonably to curb NetEase's unreasonable terms and general gamer can defend their own tights and interests from the angle of public tnterest.Within the framework of the copyright law,NetEase's user agreement is legal but unreasonable.The copyright law could not explain the problem.This paper study in the history of computer software copyright and found that the computer software has the defect of expression of thought,compared with traditional literary works.The network broadcast rights are ultimately shared by game developers and gamers.
