In the context of global climate change,disaster losses for three consecutive years in Asia were higher than other areas,among which losses caused by natural catastrophe losses were the most serious.As the industry with the highest dependence on the natural environment,agriculture is the first to suffer the impact,the effectiveness of agricultural catastrophe insurance in disaster prevention and reduction is becoming increasingly concerned all over the world.China's vast territory,huge east-west span and north-south span,longitude and latitude zonal characteristics,changeful geographical and climatic conditions are the root cause of agricultural catastrophe to a certain extent.However,at present,our property insurance premiums accounted for the proportion of GDP accounted for only 1.5%,only half the national average and the level of insurance security is only 1/10.The proportion of agricultural insurance business growth is lower than that of agricultural loss.Agricultural insurance still has a huge gap.Agricultural insurance in the disaster risk dispersion has not be effectively developed.Not only that,once agricultural catastrophe occurs,the insurance companies make huge burden,making it not only unable to save agriculture,may also unable to protect themselves.This study taking the construction of China's agricultural catastrophe insurance legal system as the goal,using literature research method,historical analysis method,empirical analysis,comparative analysis,multidisciplinary analysis,based on the quasi-public goods theory,dual externality theory,social security and welfare theory,demonstrating the necessity of government intervention in agricultural insurance in the situation that agricultural insurance fails to spread the risk of agricultural catastrophe Through the review of the development process of China's agricultural catastrophe insurance,the status quo of agricultural catastrophe legislation,the overall situation of the pilot areas,especially typical pilot areas analyzing the current situation and existing problems of agricultural catastrophe in China,demonstrating the objective reality demand of the legal system of agricultural catastrophe insurance.Through researching and combing the foreign agricultural catastrophe insurance legal system,according to the degree of government involvement which can be divided into three major types,government-led,market-oriented,government and market cooperation,which is worth learning for part of the summary.Based on the above research,put forward the basic framework of the legal system of China's agricultural catastrophe insurance legal system.In general,it includes six parts:the principle of legal system construction of agricultural catastrophe insurance,the choice of legal system construction mode,the main body of the legal system,the dispersion system of agricultural catastrophe insurance,legal supervision and auxiliary supporting measures.The research draws three conclusions,first,the necessity of government intervention in the situation that agricultural insurance fails to spread the risk of agricultural catastrophe;second it is imperative to build the legal system of China's agricultural catastrophe insurance;third,the legal system of China's agricultural catastrophe insurance system construction is a long-term project.in order to provide a useful reference for the construction of China's agricultural catastrophe insurance legal system.
