A Study On The Protection Of Intellectual Property Rights In The Achievements Of Ancient Books

The inheritance of civilization requires many forms of expression,one of which is that the protection of the collation of ancient books.However,the protection of ancient books has encountered many problems,such as whether they can be considered as works and how to protect them if they were not works on intellectual property level.Based on this,this paper is to classify the achievements of ancient books through the scientific method of historical philology,and put forward the view that not all works of ancient books can constitute works.Then it proposed that we can use the neighboring right and anti-unfair competition law to protect them.The article was divided into four parts.The first chapter discusses the necessity of protecting ancient books and its current situation.The second chapter defines the various forms of ancient collocation in the sense of philology and focuses on whether or not all kinds of works of ancient books can become works in the sense of copyright.In the third part,through the retrospective of the function of the adjacency,it discussed the corresponding naturre of the result of collation of ancient books and the function of neighboring right,and also gave the specific model of how to expand the right.In the fourth part,from the prospective of anti-unfair competition law,it discussed the feasibility and restrictions.And then it talked about the infringement problems what the ancient books publishers or ancient collectors often encounter when they finish and publish.Above all,the author thinks that not all the results of ancient books can become a copyright work,so the results of the preservation of ancient books can not be generalized,which should be considered accoridng to the current need in the specific circumstances.If the copyright can not protect the results,we can take the use of neighboring right or anti-unfair competition law into account.
