Research On The Problems And Countermeasures Of Illegal Construction In Beijing—Based On The Perspective Of City Administration And Law Enforcement

Illegal construction has always been a difficult problem in city administration.On the one hand,illegal construction is a huge threat to the social environment and economic order,the illegal construction of repeated prohibition has been a huge obstacle to the sustained and healthy development of the city.On the other hand,it is difficult to investigate and deal with illegal construction,social conflicts caused by administrative law enforcement is also likely to cause great concern in the community.With the improving of city governance standards and requirements,Beijing city proposed to refine the illegal construction management requirements,law enforcement departments,major responsibility undertakes the task is arduous,to effectively curb the spread of illegal building trend,city governance and law enforcement are facing new challenges.Under this background,how to straighten out the law enforcement of relevant laws and regulations,policies and measures,illegal construction management procedures,give full play to the role of law enforcement departments,how to avoid the barriers brought by regulations based on lack of procedures cumbersome and ineffective implementation of the situation,Beijing city governments at all levels and relevant departments to solve the problem.Therefore,it is necessary to investigate and analyze the law enforcement basis,law enforcement procedures,implementation results and problems of urban construction law enforcement departments.This paper mainly uses public administration theory,public choice theory,transaction cost theory,starting from combing the urban management department responsibilities,procedures and present situation of illegal construction,through case analysis and questionnaire survey,to evaluate the effectiveness of the regulation of illegal construction,city administration and law enforcement in Beijing city as an example to analyze the illegal construction Governance Dilemma,finally puts forward the law enforcement perspective from four aspects of system and mechanism the laws and regulations,law enforcement methods,supporting policies,regulation of illegal construction in Beijing city suggestions.The central city adhere to the guiding ideology,implement the concept of rule of law in the country,city administration and law enforcement system reform under the background of the theory and practice of law enforcement as the basis,standing on the perspective of administrative law enforcement,puts forward the concrete measures of illegal construction Governance Dilemma in Beijing City to crack,to improve the administrative law enforcement of city management standardization,legalization level,has certain practical significance.
