Rural housing is one of the most crucial property for farmers.Farmers' housing and homestead are closely connected both physically and legally.Homestead use rights are restricted to the law,therefore,farmers housing mortgage is also faced with the same situation.Since March 2016,the state council introduced a document which farmers can make their house mortgage.There are 59 countries(cities and districts)can be mortgaged pilot in the entire country,which is a good news for the pilot area of farmers,after all,there is more an asset that can be used for mortgaged,But the farmers housing mortgage also faces legal problems,it is confronted with many difficulties and restrictions in practice,need to solve the problems it faces.The paper is divided into four parts,introduce the legal issues of farmers housing mortgage through four parts.Firstly,the first part is the outline of farmers housing mortgage.It mainly introduces the concept and characteristics of farmers housing,expounds the legal feature of the homestead use rights,and explains the significance of farmers housing mortgage.You can know the basic situation of farmers housing mortgage.Secondly,the second part introduce farmer housing mortgage which try and explore around the country.From March 2016 to now,the pilot area carry out the pilot work of farmer housing which has been more than one year,but the country has59 pilot areas,located in 27 provinces,span is very large,therefore,it only can cite the East,Central,West provinces to explain,elaborate the pilot areas of the main practices,characters at the same time,and summarize the pilot area of the mortgage model.By describing the pilot areas of the pilot area,we can better absorb the useful experience of the pilot area.Again,the third part is the problem and dilemma of farmer housing mortgage.After all,farmer housing mortgage is a new thing,it certainly encounter a lot of problems in law and practice,such as registration,party,risk prevention,collateral disposal and other issues,these problems are inevitable,it also faces these questions in the pilot process.Only an express analysis of these issues,we can prepare the proposal the improving farmer housing mortgage.Finally,the fourth part is suggestion which improves farmer housing mortgage.It is necessary todeal with the problem of farmer housing mortgage through a series of suggestions,and suggestion can be better implemented to the work.It can't give up this reform because of difficulties.In fact,farmer housing is a good thing for farmers.It is inseparable from homesteads.Although the existing law restrict the homestead mortgage,but homestead use rights system can be improved from the legislation,after all,leading the reform of the law is the most correct.
