Research Of Legal Construction In Hubei-henan-anhui Revolutionary Base Area

Hubei-Henan-Anhui revolutionary base area is one of the most area founded by CPC during land revolution and only next to Central Soviet Area at that time.Located in Da Bie Mountain Area at the provinces junction of Hubei,Henan and Anhui,it has26 county level regimes,about 3.5 million populations and 45 thousand main forces of Red Army.It consist of three red area,Hubei-Henna Border,Southeast Henan and West Anhui.From the first Congress of Workers' and Peasants' Representatives in Hubei-Henan Border in December,1929 to the end of soviet regimes in November,1929,local soviet regime has legislated a lot and established related judicial organs to build a judicial system with local features and make a good exploration in legal construction.Publications focusing on legal construction of Hebei-Henan-Anhui revolutionary base area have not yet been seen.But the research achievements in this field roughly fall into four categories: macro research of the legal construction;research of the setting and function of judicial organ and system;research of the contents and historical function of land law,marriage law and economic law;research of the relation between Dong Biwu,Zhang Guotao and legal construction.On the whole,related research is too dispersing and limited,especially while research on Hubei-Henan-Anhui revolutionary base area is not systematic and technical enough.By collecting and organizing local legal documents of Hubei-Henan-Anhui revolutionary base area,this article organizes historical documents according to present legal system and studies and analyzes local legal construction,based on previous research results.By dividing specific development stage,it introduces local legal construction affairs and legal function and summarizes the characters,disadvantages and experience,which fills in the blank of legal construction research on Hubei-Henan-Anhui revolutionary base area.This article consists of five chapters.The first chapter is introduction,which is about background,purpose,present situation,contents,methods,basic definition,innovation and weakness of research on legal construction of base area.The second chapter is legal construction overview of Hubei-Henan-Anhui revolutionary base area,which falls into three categories,historical outline,historical background and basic stages.This chapter objectively shows the total process of legislation history of base area by dividing it into 3 stages,beginning,blossom and frustration.The third chapter focus on juridical system and organs by analyzing procurator,jurisdiction and prison.It also introduces system and function of procurator committee of worker and peasants,revolutionary court,revolutionary,military court,red police and political security bureau.The forth chapter is mainly about research on department law of Hubei-Henan-Anhui revolutionary base area,which includes constitution,administrative,criminal,civil and economic law.The fifth chapter summarizes character,experience and lesson of local legal construction.This article organizes the condition of legal construction in Hubei-Henan-Anhui revolutionary base area,analyzes weakness and experience of legal construction caused by organ setting and left-leaning mistakes and eventually conclude that legal construction should seek truth from facts,realize scientific legislation,guarantee legal standardization to promote law-based governance and achieve a good legal environment with scientific legislation,strict enforcement,judicial justice and entire law-abiding.
