Since the reform and opening,China's higher education has experienced the stages of "elite education" and "popular education",and gradually go ahead to the stage of "universal education".The scale of higher education has been expanding and the number of students has been increasing.We have become a great power nation of education in the world.In recent years,China's colleges and universities are seeking the mode of intensive development,focusing on improving the quality of higher education,trying to enhance discipline strength.As we know,the scale of higher education expansion and quality improvement depend on the continuous investment in higher education.At present,China's fiscal revenue growth slows down,the continued stability of higher education funding is facing challenges.At the same time,the development of socialist market economy has fostered the growth of the entrepreneurial groups,and parts of charitable entrepreneurs have sought to help the development of higher education,which brings new opportunities for the higher education funding.Therefore,higher education funding are both facing challenges and opportunities,resolving the challenges and seizing the opportunity have become a new issue.Many scholars have conducted a study on the issue of higher education investment in-depth from multidisciplinary perspectives,and have achieved fruitful research results.On the basis of the scholars' research,i carry on research of this issue from the perspective of the legal point of view and foothold.My research not only is in view of the reality of China's higher education investment and its legislation,but also apply the measurement model to explain the impact between legal factor and higher education investment.And ultimately i strive to improve China's higher education investment legislation to protect China's higher education investment sustained and stable growth.The full text is composed of five parts.The first part is the introduction,i have introduced the research background,the purpose and significance,the research contents and methods.Meanwhile,i have presented the relevant literature of higher education investment and its legislation.The second part is the conceptual definition and theoretical basis.On the basis of clearly defining the concept and classification of higher educationinvestment,the theoretical basis of the research is summarized and clarified: Quasi public product theory,the theory of ruling by law and Input-Output theory.The third part is the current situation analysis and historical analysis.Based on the actual data of China's higher education investment from 1992 to 2014,i have analyzed the development course,current situation and problems of China's higher education investment and its legislation.The fourth part is the econometric analysis,the use of Eviews software and dummy variable technology,i have analyzed the legal factors how to influence higher education investment.The fifth part is the research summary and countermeasure suggestion,on the basis of the research of the first four parts,from the legislative idea,i have advised how to perfect our higher education legislation.Based on the combination of quantitative and qualitative methods,this paper have draw conclusions: the investment of higher education is unreasonable,the distribution of higher education funding is not scientific,the investment efficiency is not high,and measurement model analysis results show that the development of good law has a positive effect on the investment in higher education.Therefore,the key to higher education investment legislation is to improve the quality of legislation.Finally,this research puts forward the countermeasures and suggestions,from the value level,the formal level,the actual level,to perfect higher education funding legislation.
