In China, the development of higher vocational education is considered as an important work for the economy and the whole education system. However, What mismatches this system are the imperfect of vocational education legislation and the weakness of supervision to vocational education. According to the above problems, drawing on the experiences of some highly developed countries, this essay will provide successful models of higher vocational education legislation of America, Germany and Japan to introduce the characters of higher vocational education legislation, then compare and analyze some common places between the foreign countries and China.The science and technology of America is the best in the world, which makes all aspects of the society develop very quickly. In the development of the science and technology, vocational education makes a very important role. The higher vocational education contributes itself to the higher education of America in a popular style. Institutionalizing of vocational education is an important way for efficient management, it also ensure the development of the vocational education. The vocational education law makes a direction role for the development of the vocational education of America. The higher vocational education deeply benefited from the law of the higher vocational education. German vocational education has been a successful experience, we have learned from the vocational education in the form of "double system", "act-oriented approach", to "process-oriented curriculum design". At the same time, we should not ignore that Germany has a perfect set of laws and regulations in vocational education. Several characteristics of vocational education in Japan can be summed up such as mature law system, put emphasis on administrating teaching in conformity with law, promote the development and innovation of vocational education, the law always be amended according to change of the society, legal clauses is detailed, and duty is explicit.The emphasis will also be placed on the potential solutions, like:to insist firmly on the principles of legislation system and indigenization; to complete the present vocational education legislation; to clear the powers among different departments for vocational education; to execute the legislation strictly; to supervise the legislation rigorously; to strengthen the sense of HVEL; to make contributions for building the healthier and better Higher Vocational Education Legislation of China.There are four parts in this paper. The introduction is the first part, in which the author explains the bases, purposes, meaning, methods, emphases, difficulties and originalities of the research. In the second part the concept of the higher vocational education institutionalizing was analyzed. The compare and analysis of successful models of higher vocational education legislation of America, Germany and Japan was the main content in the third part. And in the four part the author gives the suggestion and her own thought in the construction on the higher vocational education and its institutionalizing.
