Third party financial institutions are gradually well received by the clients who have needs of personal financing and play an increasingly important role in people's life because they can provide personalized comprehensive financial management services combined with clients' own situation and needs in a neutral position.At present,third-party financial management has become an important part of global financial field,the proportion of third-party financial market in the world's financial market is also growing.Third-party financial institutions experienced rapid development in our country.During the process of development they also encountered many problems and a lot of controversies.What caused those controversies is that the legal supervision on these insititutions is not sufficient currently,resulting in the standardized degree of third party financial market is too low,the competitive power of third party financial insititutions is hard to further improve and the financialunrest.Therefore,the solution of this problem is imminent.This paper consists of four parts.The first part mainly expounds the basic theory of third-party financial institutions.Firstly,third-party financial institutions' connotation is fully showed by introducing their concept and characteristics.Then,three kinds of legal form which are possiblely taked are analyzed.Finally the influencing factors of third-party financial institutions development are introduces in order to make the readers clarify the concept and also have a preliminary understanding of the overall situation.The second part focuses on the problems that exist in the legal supervision of third party financial institutions in our country.In this part,after the simple introduction of the developing process of third party financial institutions in our country,emphatically points out three existing major problems including the supervision of the main body is not clear,the regulatory legislation is not perfect and the legal supervision system is not comprehensive.Then,detailed analysis of these three problems is made in order to point out the main sticking pointof the inadequate supervision on the third party financial institutions in our country.Taking Hongkong area in China,Australia and the United States for instance,the author first briefly introduces the development of their third party financial institutions,and then focuses on their legal supervision situation in the third part.Aiming at learning valuable experience,this part fully demonstrates the different characteristics of ways of legal supervision in each area and country:mixed supervision under the cooperation among regulators in Hongkong area in China,legal and institutional specializedsupervision in Australia and tight regulation in the background of mature financial market in the United States.For solving the existing problems,the author puts forward some suggestions combined with the actual situation.In this part,the author puts forward comprehensive suggestions from the aspects of the supervision of the main body,the regulatory legislation and the legal supervision system,in order to enrich the research in this field and do my bit to the work of pefection on the legal supervision of third party financial institutions in China.
