Since the launch of the Internet,the rapid growth of Internet users every day,it is constantly changing people's lives,China has entered the Internet age.Whether it is grassroots or stars,whether it is the biggest names or civilians,the network can speak freely,their own concerns about the current affairs,people's livelihood,entertainment,learning,life,fashion and other aspects of things say a few words and phrases.At the same time,in recent years appeared in a variety of microblogging,WeChat,paste it and other network environment social platform reputation infringement cases,caused widespread discussion of the masses and the legal profession.Virtual network environment is not as tangible as the real world,reputation infringement is also more abstract,so there are different new problems,but also need to be different from the new study.The network environment is virtual,but it does not mean that it has no legal boundaries.This paper analyzes the legal principles of reputation infringement in the network environment under the network environment,and collates the legislation status of reputation in the network environment,and summarizes the existing network environment.And then try to improve the legal system and protection of our country's network environment reputation by referring to foreign advanced legal experience.This paper is divided into five parts,layers of progressive on the network environment in the reputation of the right to infringement analysis.The first part chooses the case of network reputation right in life,and draws out the importance of infringement of reputation right in the network environment.It introduces the infringement of network environment reputation from three aspects: concept,characteristic infringing type.The second part discusses the legal principle of reputation infringement in the network environment,including the principle of imputation,constituent elements,responsibility,exemption and the right of reputation and freedom of speech in the network environment.The third part of the existing legal situation in China to sort out,coupled with the previous analysis of the legal principles,from the table and in order to sum up China's network environment under the protection of reputation problems.The fourth part seeks the legal status of the right of reputation in the foreign network field,and selects the German and American countries of Germany,the United States and the United States and the civil law system of Germany and the United States,through comparative analysis and then consider the foreign law worthy of our reference.The fifth part puts forward the author's suggestion on the perfection of the protection of the right of reputation in the network environment of our country,and makes suggestions on the four aspects of legislative,judicial,network and moral restrictions.Able to study the reputation of the network environment to do modest.
