Research On Criminal Summary Procedure

At present our country is in the period of social transition,interest and right litigation appear diversified development trends,and criminal offences appear high trend.It is most necessary to search an effective way of criminal case's processing except for a complicated criminal ordinary procedure when judicial resources and judicial officers are limited.Therefore,by researching the criminal summary procedure,the rational allocation of limited judicial resources could integrate judic ial justice and procedure efficiency so as to fully playing the important role in criminal cases.The main research method includes historical analysis,comparative analysis,documentary analysis and empirical analysis.This paper is summarized from four aspects,including conceptual features,scope of application,value and the relationship with expeditious procedure.This paper researches on the justice benefits and efficiency value of criminal summary procedure,in order to discover theories foundation and research significance.Meanwhile,extraterritorial criminal summary procedure has two characteristics: one is diversified and hierarchical;the other is simplistic litigation process.From the perspective of legal provisions and judicial practice,investigating extraterritorial legislation for the establishment of criminal summary procedure compare with our criminal summary procedure,to discover problems of our criminal summary procedure.At the same time,this paper combines judicial practice and extraterritorial legislation in order that summary procedure can improve and make better use of juridical practice.Last but not least,this paper puts forward to some ideas in the future,trying to clarify the relationship between the criminal summary procedure and expeditious procedure,and looking forward to improving our criminal the division between co mplex and simple.
