The Construction Of Official Property Declaration System In China

Official property declaration system is an effective measure to prevent corruption,and more than 100 countries have established the system and put into effect.China first proposed the establishment of property declaration system in the 80s of last century,but has not yet created a special "official property declaration law".China has issued the leading cadres to declare personal property laws and regulations of the party in 2001 and 2010,the official property declaration made some provisions,but the provisions of the declaration of the main body,declaration content,and accepting the audit organs and so on is not reasonable and clear,the result is not ideal,our country has not set up the legal system of official property declaration.With the frequent occurrence of corruption,anti-corruption efforts to increase the official property declaration system has returned to people’s vision,on some key problems in the construction of the system,experts have put forward their own views and suggestions.Analyzes the present situation of China,and expounds the theoretical basis and objective conditions of the formulation and implementation of the system.Although in the implementation of the official property declaration system will face a lot of resistance,but this is the direction of democratic politics,it is the inevitable requirement of the construction of the Party style.This paper intends to further explore the connotation of the system in a comparative study.Based on the comparative study of relevant foreign legislation and pilot experience,this paper puts forward the legislative conception of the declaration system of official property in combination with China’s national conditions.This article from three parts to elaborate:first,the summary of official assets declaration system.First of all,it explains the meaning of official property declaration system,and then explains the origin of official property declaration system.Two,the construction of the declaration of the principles and the selection of legislative mode.The principles include democratic science,effectiveness and operability,supervision and protection.Three,analysis of the country in the establishment of official property declaration of the legal process of the four difficulties.Mainly including the declaration subject,declaration content,reporting and auditing organs,declare publicly and the construction of supporting measures.From the rule of the party,domestic pilot experience and foreign legislative perspective on these four key issues to study,draw useful experience for China to build the official property declaration legal system to provide theoretical support.The author believes that establish the legal system of property declaration can be achieved from the source to prevent corruption,the use of legal constraints on the power,the real power to shut the cage system.
