Research On The Effect Of Hybrid Arbitration

In this paper,after analyzing the new arbitration rules of ICC in 2012,the author makes an analysis of the effect of ICC hybrid arbitration clause and the recognition and enforcement of the hybrid arbitration award.It consists of the following parts:Chapter one discusses background as by the ICC International Court of arbitration clause second in 2012 revised the rules of ICC,with a typical case of hybrid arbitration clause,the effectiveness of combining case involving ICC talk about hybrid arbitration clause and admit to ICC hybrid arbitration problems.Chapter two discusses background of today's commercial arbitration gradually prosperous,the reasons involving ICC hybrid arbitration clause and the value of ICC hybrid arbitration.Further analysis of the effect of hybrid arbitration clause of ICC has been questioned and whether the hybrid arbitration award of ICC can be recognized and implemented by foreign countries.Chapter three focuses on the question of whether the hybrid arbitration clause of ICC is effective,expounds the attitude of the parties in the practice and the concrete manifestation in the arbitration practice.Then,the author explains the reason why the validity of the hybrid arbitration clause of ICC be affirmed.Chapter four discusses the recognition and enforcement standards of the country in which the ICC is applied to the hybrid arbitration award.Then write ICC hybrid arbitration award encountered the obstacles in the process.Finally,the author puts forward some suggestions on the recognition and enforcement of the hybrid arbitration award concerning ICC in china.
