Research On The Legal Issues Of Terrorist Crimes In China

Recently,the development of science and technology and economy has been growing rapidly which has provided a easy environment for terrorist crimes and the terrorist activities crime occur frequently.The terrorist activities of Honghe Autonomous Prefecture of Yunnan Province in 2013 is a typical case under the current background.The Amendment to Criminal Law(9)is on the basis of the current situation,improved the rules about terrorist activities in China's criminal law.This paper is based on the terrorist activities rules in the Amendment to Criminal Law(9),discusses the terrorist crime problems in law,including the characteristics of new rules in the Amendment to Criminal Law(9)and the problems those should be clarified.The first part is principal about debating the example of the case.To raise the new rules about terrorist crime in the Amendment to Criminal Law(9)by analyzing the cases before the amendment.And explain the charges and concepts related in order to pave the way for the discussions below.The second part mainly discusses the historical evolution of terrorist crime in China and the rules and characteristics of terrorist crime in the Amendment to Criminal Law(9),including the characteristics of early protection of legal interests,the expanded scope of punishment,the strict degree of punishment.The third party researches on transformation of the composition of crime in terrorist crime,this paper expounds three aspects including the definition of helping behavior;the early protection of legal interests and the crossing of constitutive elements.The fourth part discusses the existing problems of terrorist crime in China,combined with the academic views points and the personal understanding of the author,explores the hot spots of the cases in the first paragraph,and analyze the punishment of criminal facilitation;the punishment of preparation for the implementation of terrorist acts;and the issue of whether the crime of terrorism includes preparation for the crime of others.Finally,based on the practical recommendations for combatting terrorist crimes in current laws and rules,in order to better apply the current law,to regulate the crime of terrorism through efficiency maximization,better protect the society and citizens' safety of life and property.
