Study On The Legal Issues Of The Returning Of Chinese-Funded Flag Of Convenience Ships Under Ship Registrationsystem

The existence of the issue of Chinese flag of convenience ships has been restricting the development of shipping industry in China, which is a barrier for our country to change into a maritime powers. Compared with the traditional registration system in our country, the system of flag of convenience has its own advantage and convenience. The work of achieving Chinese flag of convenience ships returning back to China could not go smoothly. In order to guarantee the stability of our country's shipping order, to improve the healthy development of our country's shipping industry and to promote the construction of our country's shipping powers,we must take measures to attract Chinese flag of convenience ships to return to the motherland and improve the strength of the five-star red flag fleet.Supported by the theory of ship registration system, this paper fully analyzes the background and reasons of the flag of convenience. Based on the analysis of the impact of flag of convenience, the basic national conditions and the successful experience of some other foreign countries, we concluded that we shall solve the flag of convenience issue from three aspects including legislation, system and policy. We need to improve "The Ship Registration Regulation",enact "The International Ship Registration Regulation" and "The Chinese Overseas Nationalization Ship Management Measures" , etc. We should improve China 's ship registration system,establish international ship registration system and import ship tonnage tax sysem. We should optimize the related policies, introduce more preferential tax policies and financial policies, so that we can provide better environment and more platforms for Chinese shipping companies.
