The Analysis Of Death Penalty Applicable Conditions On Bribery Crime

After “Amendment(IX)to the Criminal Law” and “Interpretation of several issues concerning the application of law in the case of criminal cases of corruption and bribery”,the conviction and punishment standards of bribery is becoming more complete,the restriction about the death penalty is more tightened.However,the applicable condition and the applicable standards of bribery is still not to the attention of the academia.Reviewing death penalty legislation and judicial practice in the bribery,the death penalty of bribery have the following five characteristics,that is the number of death penalty cases is low and death sentence with a two-year reprieve is more common;the amount is the decisive factor in the application of the death penalty and the amount standard is constantly improving;bribe holders have higher positions and powers;the application of the death penalty has great regional differences and case difference.n the other hand,we find out that the death penalty of bribery have the following three problems,that is bribery do not have independent standard,the applicable condition of death penalty is not clear,different conditions of execution of the death penalty are not clear.So,it's significant to perfect the applicable condition on bribery crime to avoid uneven crimes and judicial confusion,perfecting the death penalty's applicable condition of bribery,defining the conditions for the execution of the death penalty.Finally,solve the problem,in order to perfect the applicable condition on death penalty and promote the improvement of our country anti-corruption construction.
