The Research On The Finalization Mechanism Of The Petition Letter Concerned Lawsuit System

Petition letter concerned lawsuit as an important part of letter petition is playing a more and more important role in the system of solving the social disputes.The courts at all levels are also paying more and more attention to the importance of petition letter concerned lawsuit system,for instance <Measures of the people’s court for the termination of cases involving letters and visits> enacted by the SPC in May 2011,<Work procedures of the petition letter concerned lawsuit for the courts of Guangdong province>enacted in 2014,these laws and regulations play an important role in properly ending the case of petition letter concerned lawsuit.Although the courts at all levels attach great importance to the function of petition letter concerned lawsuit in easing social conflicts and maintaining social stability.Petition letter concerned lawsuit seems to appear a very bizarre phenomenon in the concrete practice:more and more court’s support,can not fundamentally solve the embarrassing situation where petition letter concerned lawsuit procedure is difficult to end,which bringing a lot of volatility to the harmonious and stable social environment.It should be said that the enactment of several files having an important status and influence in the development of the petition letter concerned lawsuit,but the difficult situation of petition letter concerned lawsuit is not fundamentally improved,whose root cause is that the above-mentioned documents are written roughly,macroscopically and not refining the the legal procedure should be complied with,there is still room for further discussion.This paper will take the cases of petition letter concerned lawsuit tried by the courts in F city,L province from 2013 to 2016 as analysis samples,summarize out the dilemma in courts in trying cases of petition letter concerned lawsuit and find the reason leading to these problems.Improving the system design of the finalization mechanism of petition letter concerned lawsuit,reducing the disadvantages in the procedure of petition letter concerned lawsuit,defining the behavior of all parties in the process of petition letter concerned lawsuit may be the feasible solutions.
