Study On The TPP Transparency

Transparency is an important factor to measure whether the rules of international economy and trade legal.At the same time,it is the basis of free trade.No transparency,there is no real free trade.Under the background of WTO,transparency only focuses on the openness and availability of information,ignores the public participation,and the applicable scope of transparency is narrow,the standard is low,the rules are imperfect.To a certain extent,these problems hindered the development of free trade.Aiming at the problems of WTO transparency,the TPP introduced a system of public participation,expand the scope of application of transparency and improved the system of transparency.Compared with the rules of WTO transparency,in legislation model,scope of application,information release,public participation,cooperation mechanism,the TPP is superior to the WTO.In the information announcement,enquiry points and contact points,the TPP learns from the experience of the WTO,so TPP is similar with the provisions of the WTO;In terms of information and protection of the legal system,the WTO is more comprehensive.In terms of system guarantee,the TPP is more emphasis on domestic security system.The TPP transparent rules represent the development direction of international economic and trade rules,the expansion of the scope of the public participation mechanism,cooperation mechanism,the establishment of domestic safeguard mechanism have a significant impact to the existing international economic and trade rules.At the same time,it also brings challenge to national sovereignty.After joining the WTO,China undertakes a super "WTO obligations",in terms of transparency and actively implements the promised.To some extent,this forces China established a relatively high standard transparency.However,in legislation model,scope of application,system construction,there is a big gap between TPP transparency and ours.Therefore,to perfect our system of transparency and actively respond to the challenge of national sovereignty,we should study the TPP transparency.This dissertation includes the introduction,body and conclusion,and five chapters,in total about thirty thousand words.Chapter 1 is summary of transparency,mainly analyzes the definition,status of transparency.Chapter 2 is the legislation of TPP transparency,includes the scope of application.Mainly analyzes the legislative mode and scope of application.Through the comparison with the transparency of WTO,we can find the characteristics of TPP transparency.Chapter 3 is the content of TPP transparency,analyzes the TPP transparent from the information,provide information,contact points and enquiry points,public participation,cooperative system.On this basis,comparing with the content of the transparency of WTO,analyzes the differences between them in content.Chapter 4 is system guarantee,analyzes it from the international and domestic aspects.Through comparing with the system guarantee of WTO,analyses their respective advantages and disadvantages.Chapter 5 is the influence of the TPP and how to response.On the basis of the above,analyzes its effects.The innovation of the TPP transparent rules suggests that the focus of the international economy's rules is transferring from border to border within the rules.Public participation is the indispensable content of the international economy's rules.Cooperation mechanism is the effective means to ease the differentiation of the international economy's rules.At the same time,these also bring unprecedented challenges to the national sovereignty.TPP transparency represents the future development direction of international economic and trade rules,our country should draw lessons from it's advanced experience and perfect the construction of transparency.On the basis of that,we should advance the Chinese version transparency.In addition,we should pay attention to the maintenance of national sovereignty in the global and regional in trade negotiations.
