Discussion On Some Legal Problems Of Regulation About Internet-booking Car

Along with the popularity of the mobile Internet,internet-booking car has been the best breakthrough point of the development of sharing economy in china.Since internet-booking car appeared in our country,it has experienced a transition process of negative-neutral-legalization.As the promulgation of"Provisional management measures of internet taxi-booking service",hereinafter referred to as "management measure",our country has become the first nation which legalizing internet-booking car services on national level in the word.It has given the guiding rules for the internet-booking car on Market access,management behavior,legal responsibility and supervision and inspection.However,legalization of internet-booking car is just a start,mechanically adopting the traditional taxi management system,has not suited to the internet-booking car service.In the lands of the specific implementation process of the New Deal,there are series of controversial from all walks of life,Mainly concentrated in terms of the administrative examination and approval system of market access,the identified of legal responsibility and the insurance system of internet-booking car services.In this paper,I will analyze the problems that existing in the internet-booking car supervision and put forward the specific suggestions,in order to promote the internet-booking car industry healthy and orderly development.This paper is mainly divided into four parts:Firstly,I will make a brief overview of the basic theory of internet-booking car,introduce its origin and development and summarize the reason,analyze its legal relationship under different operation mode;Secondly,I will point out the necessity of regulation,summarize the development of regulation course and present domestic situation of regulation about internet-booking car;Thirdly,mainly analyze the problems existing in the internet-booking car regulation in our country,such as excessive government intervention to the market,the indefinite of legal responsibility and the imperfect insurance system.Meanwhile,analyzes its reason.Finally,on the basis of above analyzing,put forward that we should adopt regulatory model such as "government regulate platform,platform regulate driver and car",clearing the main legal responsibility,improving the internet-booking car insurance system,making internet-booking car service in accordance with the law and stipulation.
