Study On The Legal Regulation Of Electric-bicycle In City Urban Traffic

In recent year,with the rapid development of electric-bicycle in the whole area of China,it brings varieties of social problems,especially in urban traffic.So,there are so much positive meaning to build a comprehensive and proper regulations to electric-bicycle.For one hand,as a legal method of transportation,electric-bicycle has the right of way as other traffic subject as they have.On the other hand,only by making a proper definition about electric-bicycle can make a regulation for it effectively and fairly,and ensure the harmonious environment of city traffic.The full text of this dissertation is divided into four chapters:Chapter 1 introduces the general situation about electric-bicycle in China.Then the author expounds the legal regulations of the country,and summarizes the different kinds of management modes in electric-bicycle in major cities.In Chapter 2,the author analyses the concrete problems of the existing legal regulations.It performances as definite unproperly,unjust regulations,the measures can't be systematic and coherent,and the lack of insurance guarantee.Chapter 3 discusses the legal character of electric-bicycle,analyses the flaw and hole of the existing legal system in China,and discusses whether it has the necessity and feasibility to revising the definition of electric-bicycle according to its character of automotive vehicle.In Chapter 4,the author proposes the ideas about optimizing the regulations of electric-bicycle according to conclusion of the former Chapter.First of all,defines electric-bicycle as the automotive vehicle,and make some preparation for the transition of different national standard.Secondly,making a pertinency legal system for governing every links of electric-bicycle.Finally,according to established legal regulations,comprehensively strengthens the law enforcement supervision,resolutely investigates and deals with the act in violation of regulations.The final part is brief peroration,generalizes the thesis and ideas,and summarizes the key thought.
