Study On Civil Case Prosecutorial Supervision

Procuratorial organs is on behalf of the state to exercise prosecutorial rights.As our country’s legal supervision organs,the people’s procuratorate have the right to supervise civil proceedings.So civil case-filing should be included in prosecutorial supervision.Because of the lack of theory and practice,prosecutorial supervision is not given full play to the stage of civil case-filing register.Our country’s civil case-filing register system is still relatively new,so there are many problems that have not been solved thoroughly.Solving problem not only depend on changing the case-filing system but also make full use of prosecutorial supervision in the stage of case-filing.This essay,which is on the background of case-filing,summarizes and analyses the shortcomings of prosecutorial supervision in this process by narrating the problems in civil case-filing register.And then put forward the utilization way of prosecutorial supervision that is according to our country’s practice.This article is divided into four parts.The first part is the overview of prosecutorial supervision and civil case-filing register.This part introduces the basic components of prosecutorial supervision and civil case-filing register.And then discusses the relationship between prosecutorial supervision and civil case-filing register from the aspects of meaning,laws and power.The second part,which is on the background of civil case-filing system,focuses on discovering problem in the stage of civil case-filing register by combining practical cases,and then looks for the deficiencies of civil case prosecutorial supervisionand analyzes them.The third part discusses the necessity of prosecutorial supervision.The last part proposes the way of how to practise prosecutorial supervision.
