The Research Of Uniform Domain Name Dispute Resolution Policy Proceeding

With the development of internet economy,the economical value of domain name has been emerging.Enterprises and companies have thought highly of domain name value.On this background,the number of domain name dispute has the rising tendency.But currently,in our country academical legal research,scholars pay attention to the relationship between domain name and trademark,not concerning with the research of uniform domain name dispute resolution proceeding.To fulfill the blankness,I decide to focus on proceeding itself.To acquire better research result,and enlightened by foreign scholars,I decide to bring quantitative analysis into my research.This thesis is five part,the first part analyzes domain name and domain name dispute,defining and introducing relational concept.The second part makes a introduction of uniform domain name dispute resolution proceeding and its providers,discussing the jurisdiction under the UDRP.The third part evaluates the proceeding and makes a research of UDRP proceeding successful and controversial aspect.To acquire further research of controversial aspect in UDRP proceeding,in the forth part I adopt quantitative analysis to research.Through data collection,empirical study of the factors that affected proceeding win rates,finding these factors influence upon justice in dimension and direction.After finishing empirical study,I make conclusion in final part.After pointing out the proceeding defect,I make suggestion to UDRP proceedings.
