On The Perfection Of Criminal Legal Aid System

The legal aid system refers to the legal protection system of the social weak, which provides free legal help to the social weak through the establishment of specialized agencies, economic difficulties or other factors, which can not guarantee their social rights through conventional legal remedies.The initial form of the legal aid system is criminal legal aid, which is the most important and minimum legal aid. In the modern legal aid system, the criminal legal aid is the most basic position, referring to the legal protection system of the legal service in the criminal case, according to the law provides for the economic difficulties or other parties that meet the legal conditions. The purpose is to ensure that any citizen entering criminal proceedings has equal opportunity to achieve substantive justice and to ensure the true realization of "equality before the law". Since the establishment of legal aid system in the 1990s and the implementation of the legal aid regulations by the state Council in 2003, the legal aid system in China has been further perfected and developed.The role of criminal legal aid in the process of building a harmonious society in China has been strengthened, and has achieved a series of remarkable results, but the criminal legal aid system still has some problems in theory and practice,these problems directly affect and relate to the basic function of criminal legal aid. This paper analyzes and expounds the problems of the current criminal legal aid system in China,puts forward several amendments to improve the opinion, hoping for the reform of the criminal legal aid system in China.
