Migrant workers are the result of peasant differentiation. It’s a special group ofeconomic and social transition. Such a large team has played a very important role indevelopment of the city where they moved in. As the passage of time and socialdevelopment, the issue on migrant workers has got a new development. A new class ofmigrant workers emerges. This new class of migrant workers has also been called thesecond generation of migrant workers, which means those special groups can not returnto rural areas and also difficult to integrate into the city. It mainly refers to the peoplewho was born from1980to1994and take those people who were born after1980and1990as the representative of a new generation of migrant workers. Their ultimate homeis no longer farmers, but workers and citizens. The formation of this group and itsstrongly growing has made a profound impact on China’s economic development.The paper is divided into three parts. The introduction mainly expounded thesignificance of choosing this topic about the detective employment protectionmechanism on the new generation of migrant workers. The first part mainly gives adefinition on the new generation of migrant workers and describes the problems theyare facing in employment rights protection. Besides, it also analyzes the similarities anddifferences between the new and the old generation of migrant workers, in order to findthe root of employment discrimination.The second part firstly put forward an idea to build an employment servicemechanism for the new migrant workers group, mainly including governmentaccountability mechanisms, the employing unit accountability mechanisms, as well asthe construction of social welfare organizations. Secondly, it describes how to eliminateemployment discrimination, protecting their employment rights and solve problems onemployment promotion on the aspect of Information construction, legal aid, vocationaltraining, humane care, and contract management etc.The third part analyzes the relevant provisions of current legislation with respect tothe employment discrimination in the new generation of migrant workers. The paperpoints out that the deficiencies of the current constitution, labor law and EmploymentPromotion Law, proposing the corresponding theoretical improvement ideas.With the development of our society, to further promote the city economy needs more migrant workers’ painstaking efforts, especially the new generation of migrant workers.Therefore, the author think that, to solve the problem happened in the new generation ofmigrant workers and let them truly integrate into the city, we should firstly face up tothe issues on their equal employment rights security, actively and earnestly assist themto solve their difficult employment problem.
