Research On The Record Review Recovery Of Administrative Normative Documents

Administrative normative documents is very significant for the development of politics and economy in our country,which is not only the important premise for the government offices to exercise authority lawfully and legitimately,but also the guarantee for our citizen to protect lawful rights and interests.This paper beginning with the basic problem of the record review recovery of administrative normative documents,introduces the basic content and function of the record review systems of administrative normative documents.In accord with study on the main components,such as recovery subject,recovery standard,recovery method,analyze the recovery result,find out a lot of problems and deficiencies.At first,the legislative regulations are undistributed.On the one hand,lack of law which can manage the recovery procedure.On the other hand,there are divergences between the local government regulations and local government rules.Secondly,lack of recovery capability.Not only incomplete in institutional setup and personnel allocation,but also their recognition capability is limited.Thirdly,the recovery method is not rigorous.The applicative recovery method and condition have not been explicitly stipulated.Fourthly,the recovery results are hardly executed.The system not only lacks of supervision to execute recovery results,but also lacks of responsibility investigation to administration and officer which have not executed the recovery results.Fifthly,the system lacks of responsibility investigation system.According to analyzes the current situation of recovery system,finds out the problems and deficiencies,include law-making stipulation is incomplete,the recovery ability is insufficient,the recovery method is imprecision,the recovery result is futile and lack of accountability system.In allusion to the problem of the present recovery system,this paper comes up with some suggestion.At first,the processing power of the recovery has to be improved,it is significant to improve the structure of government bodies and personnel allocation,the ability of the recognition to the administrative normative documents have to be improved either.Secondly,a kind of typed recovery method has to be founded.According to the standard confirm the range of application of kinds of recovery methods,aim to establish structural system,so that all kinds of recovery cases can find out the optimal recovery methods for adoption.Then the recovery standard has to be established.In addition,optimize the result of recovery is not only to confirm the feedback system,but also stipulate the processes of the feedback system.A feedback system should be established,which not only establish feedback regulations,but also regular the procedure of the feedback system.This system can solve the problem of recovery results hardly be executed and help carry out the recovery effect.At last,the responsibility investigation system has to be completed.On the one hand,the responsibility investigation of the formulating bodies should be strict,to confirm the responsibility in accordance with the level of unlawful act.On the other hand,the recovery bodies should be punished if it failure to perform the responsibility,its responsibility has to be confirmed.
